This book provides a critical analysis of the criminal justice system. All the major stages of the investigation, pre-trial and trial process are examined in turn. An introductory chapter introduces theoretical material and puts the system into context. The book then looks at the most important aspects of policing and police powers, the prosecution process, the rights of suspects and victims, court processes, and appeals against conviction. Several themes run throughout the book: what remedies are available to suspects, defendants and victims when they are denied their rights; controversial matters such as whether criminal justice is taking a turn towards authoritarianism; and less coercive strategies of law enforcement such as restorative justice and the 'compliance' approaches of agencies such as health and safety bodies. Every chapter incorporates a unique combination of traditional legal material, empirical research findings and socio-legal analysis, making it suitable for students of law, criminology and social science. The big question posed here is why miscarriages of justice occur. No system can ever be perfect, so are they simply the product of random errors? Are they the predictable consequences of a fundamentally flawed system? Or are they the inevitable trade-off against increased rights for victims? Sanders and Young do not shy away from these challenging questions or from the political implications of the answers that they provide.
